Terms of Service

BOOKINGS

For all the services contracted, certain advance payment should be made to hold the booking, on confirmed basis & the balance amount can be paid before the commencement of the services. Management personnel hold the right to decide upon the amount to be paid as advance payment, based on the nature of the service & the time left for the commencement of the service. By making travel bookings on our website or with one of our agents, or otherwise purchasing any of our travel services, you warrant that 1) you are at least 18 years of age and have the legal authority to create a binding legal obligation; 2) you accept and agree to all the Terms presented herein; and 3) all information supplied by you for the purposes of that booking is true, accurate, current, and complete to the best of your knowledge.

It is your responsibility to reconfirm the details of your booking for any omission or error. You must carefully check your reservation to confirm all pertinent details, including but not limited to: traveler names, email addresses, phone numbers, and itineraries. If you find any errors in the booking information or believe they need to be corrected, please contact the company immediately. If you fail to disclose any mistakes or omissions on time, you are solely responsible for any risks and/or expenses that result. 

BOOKING FOR OTHERS

If you make a booking on behalf of someone, you are considered the designated contact person for those other travelers. You represent and warrant that you are legally authorized to act on their behalf; that you have obtained all required consents; and that you will inform them of these Terms and warrant that they accept and agree to them. You are also responsible for making all payments due for your booking; notifying us if any changes or cancellations are required; and keeping the other travelers informed of all information relevant to your trip.

BOOKING EXTENSIONS

It is agreed that you will be responsible for paying the costs associated with any unplanned extensions of the holiday (hotel accommodations, flights, etc.) in the unlikely event that they result from airline delays, bad weather, strikes, or any other cause beyond our control. We take no responsibility for modifications, omissions, or delays made before, during, or after any journey due to technical issues, weather conditions, strikes, communication failures, or unanticipated extensions. 

BOOKING AMMENDMENT

Requests to modify an existing booking to change your package or to change your departure (to another scheduled departure date for the same package) are subject to availability of the new package or departure. Where it is practicable and within our power to do so, we may help you modify your reservation if you so choose. Keep in mind that these adjustments are subject to the supplier’s rules. Changes or Customizations may incur additional fares, fees or penalties from our vendors, particularly by our airline partners, hotels etc. When you request a change, the quote we give you will include these charges. You acknowledge that modifications to group packages are prohibited because they may have an impact on other group members. Most of the time, we might not be able to accommodate your adjustments, and we won’t be held responsible if we can’t because it’s out of our hands. It is our job to provide you the services for which you have paid. If there are any changes, we will let you know and need your permission before modifying your reservation. 

SPECIAL REQUESTS

Kindly indicate any special request you may have such as dietary restrictions, room amenities, early check in, late check-out and we will relay your requests to the airlines and our partners in destination. Travelers requiring any type of special needs/assistance must notify us of their requirements at the time of booking. We will make reasonable attempts to accommodate such special needs and to notify our airline and other partners of these requirements. However, we cannot guarantee that your requests will be honored, and some requests or restrictions may be difficult to accommodate in some destinations

MODE OF PAYMENT

Payment must be made through bank transfers to any of the company’s corporate account with the account name EDSCAN TRAVELS & TOURS LTD, we accept payment in Naira, Pounds and Euros. We will not be liable for any payments made to any other account other than the specified mode of payment. We will not be held responsible for any cancellation or change in price of package due to late payment.

PRICING 

Our rates are based on the prevailing rates as negotiated by us with the hotels, airlines etc. We do our best to provide accurate and up-to-date information on our website, social media platforms and marketing materials, however Hotels and Airlines retain the right to modify the rates without notice so it is important to reconfirm pricing and details before making payment for a particular package or service.

CANCELLATION POLICY

In the event of cancellation of tour / travel services due to any avoidable / unavoidable reason/s we must be notified of the same in writing. Cancellation charges will be effective from the date we receive advice in writing. Cancellations or no-shows are subject to penalties imposed by the supplier and according to the supplier’s terms and conditions, and the  cancellation charges would be as follows or as stipulated by the supplier: 

  • 47 days prior to arrival: 10% of the Tour / service cost
  • 30 days prior to arrival: 40% of the Tour / service cost
  • 15 days prior to arrival: 50% of the Tour / service cost
  • 14 hours prior to arrival OR No Show: No Refund

Note: Written cancellation will only be accepted on all working days

In the event that the cancellation is because of an illness or death, you are required to provide evidence to support that event. We may request a refund from supplier on compassionate ground with document provided however we cannot guarantee the outcome as the supplier has the right to waive any charges at their discretion.  

REFUND

Refunds will be processed and paid as promptly as possible. If we need to recover funds already paid to our partners for your services, your refund will be issued after those funds have been recovered. The different airlines and hotels have different refund procedures. We will help you submit a refund request to the appropriate hotel or airline for consideration. If a refund is approved, you will get it less any cancellation or administrative fees. We cannot guarantee when a particular airline or hotel will execute a refund request. Regardless of the reasons for cancellation, once a customer joins or subscribes to the package and we have commenced visa procurement and other necessary support for the customer as advertised in the package, the customer will not be entitled to any refund of the payment made. Regardless of whether or not the visa has been approved or not, the non-refund policy is in effect.

TRAVEL TIMINGS

We go out of our way to make sure that our trips and packages go as planned and go successfully. International travel may be complex, therefore we retain the right to make changes to our schedules as needed to ensure a smooth trip. All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. The time of flights and tour itineraries is supplied by the airlines and our suppliers respectively. The weather may affect any mode of transportation. It is the client’s duty to be at the airport or hotel lobby or at the designated pick up points as indicated at the appointed time. There is no assurance that any itinerary or tickets you obtain will leave at the times indicated for flights, ferries, cruises, trains, or buses. Where timeframes are given, they are simply approximations, and we disclaim all responsibility for delays of any kind or changes to the program. 

CUSTOMIZATIONS

If you want to book flights from different locations or alter or adjust one of our packages in any other way, please let us know when you make your reservation or get in touch with us beforehand. Contact us as soon as you can if you want to modify an existing reservation. If your request is feasible, we will inform you of the cost. Changes to your package after your final payment due date are typically challenging and may come at a large extra expense. Requests for substantial adjustments to our packages, especially those involving flights, such as upgrading your flight cabin, flying out of or returning to a different location, altering your trip dates, adding or removing destinations, or merging two packages are referred to as Customizations. Once you have booked a reservation and submitted a deposit, we will provide an estimate for customizations. Quotes are valid for a limited time. Once you accept our quote, we will add the amount to your balance due. Some customizations may require immediate payment while others will be payable by your final payment due date. 

For some Customizations involving flights, quoted prices cannot be guaranteed until flight tickets are issued. In this case, you can choose to pay the cost of the flights immediately to lock in your airfare, and we will issue the tickets immediately. Once flight tickets are issued, they are subject to any applicable airline policies and are generally unchangeable and nonrefundable.

GROUP PARTICIPATION

On our group tours, you’ll usually be traveling with a group of strangers, and this can sometimes be challenging, especially in a foreign country. To avoid any discord within our groups and to provide our travelers with a positive touring experience, we reserve the right to reject or remove any traveler whose behavior is determined to be incompatible with the group. If you fail to comply with a decision made by our tour manager, behave in a way that is judged to cause or likely to cause danger, distress, or material annoyance to others, interfere with the wellbeing or mobility of the group, are deemed to be fractious to the group, at our discretion and/or our tour managers and representatives, we may ask you to leave the tour. In this case, we will not refund any portion of the package cost, and all expenses incurred by the termination of the touring program are your responsibility. We may also choose not to carry you on any future trips.

FLIGHT, TRANSIT & LAYOVER

Once you have paid for and received your ticket from the airline, you accept that the ticket constitutes a contract between you and the airline and that the airline policy will control your travel plans. As a result, all concerns, including but not limited to transit hotels, missed flights and baggage-related problems, must be handled in accordance with airline rules. We may however step in to help you and the airline reach a quick and amicable conclusion. You acknowledge that our intervention does not make us liable for any of your losses.

Unless the airline specifically allows for another option, airline tickets are typically non-refundable and non-transferable. The airline alone has the authority to change passenger names, dates, times, routings, or departure/arrival airports; we have no influence over this. Your travel expenses to the airport or to any other airport if there is a connecting flight are your responsibility, unless expressly stated otherwise, we won’t be responsible if you miss your connecting flight. You agree not to derail from your planned itinerary by making any unplanned layovers. 

SUPPLIERS

To make your trip and vacation special, we partner and work with vendors who offer a variety of services. We act only in the capacity of agent for the Hotels, excursions, tours, transportation providers, cruise lines, ships, airlines, travel insurance agencies, attractions, railway etc & contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us are issued subject to terms & conditions under which these services are provided by them. We serve as the intermediary for your travel package suppliers and you. You acknowledge and agree we are not responsible for any loss, damage, delay, inconvenience, or injury to you resulting from any act or omission of any third party, including but not limited to these Suppliers, their employees, agents, servants, or representatives, that results in a breach of contract. 

Despite our best efforts to choose reputable Suppliers, we make no promises, guarantees, or warranties regarding the suitability or condition of the Supplier’s lodgings, means of transportation, or any food, drink, medication, or provisions supplied. You recognize and accept that we are not obligated to reimburse any funds paid as a result of subpar services from any supplier, either in full or in part. We are not responsible for any accident that happens while using any form of transportation during the trip, including but not limited to hotels, resorts, aircraft, buses, trains, and cruise ships, as a consequence of defective equipment or any other reason. The client acknowledges complete comprehension of the characteristics of the form of transportation and accepts full responsibility for all travel, handling, and luggage and passenger hazards. 

TRAVEL INSURANCE

We recommend you carry travel insurance or equivalent coverage. For your convenience, we offer a Travel Protection Plan provided by Allianz Insurance Plc which may be purchased with most packages. It is your obligation to purchase travel insurance to protect against illness, accidents, and other insurable events as well as loss or damage to luggage. We accept your reservation on the condition that you have enough insurance coverage, and we will not be held responsible or accountable for any acts or omissions that result from your failure to get such coverage. The insurance policy of the insurer will be sent to you in cases where you have paid for a package that includes travel insurance policy. As a result, you and the insurer are the parties to the insurance contract. You acknowledge that we are not the insurer’s representative and won’t be held accountable for any liability.   

COVID-19 AND OTHER INFECTIOUS DISEASES

Where a customer tests positive for Covid-19 or any infectious or communicable disease prior to a trip, all the funds paid and committed to the trip cannot be refunded by us and such funds will be governed by the refund policies of the service providers/vendors providing the services.

COMPLAINTS

In the event that you have any complaint, or you experience any problems with your holiday whilst away, you must immediately inform your Travel Consultant. Once you have paid the deposit, it means that you have accepted to stay in the hotel chosen, fly the airline quoted in this package and do all the activities planned for the trip. It is your responsibility to check the hotel pictures and read the reviews prior to payment. A link to view the hotels details will be provided by your Travel Consultant. In the event that you do not like the hotel or airline while on the trip and you want to cancel, no refunds will be made to you. Whilst every effort will be made to resolve your complaint to your satisfaction, the Company will not be liable for any claim.

PASSPORTS, VISAS AND HEALTH

Travel visas are required for many countries visited on our packages. Some countries also require proof of immunization against certain diseases, and minors (children under age of 18) traveling without parents, with only one parent, or with a parent of a different surname may be required to provide other documents. It is entirely the customer’s duty to ensure that all passports & visas are current, valid, obtained on time and that any vaccinations, inoculations, prophylactics (e.g. for malaria), covid-19 PCR test and the like, where required, have been obtained. The International passport validity required for most international travel is minimum of 6 months, however the required validity to visit each country may slightly vary. Customer support and guidance on visa requirements may be offered. It should be noted that we do not issue visa or in anyway assures that any client will receive one. We will not be held responsible for the customer’s visa denial or delay, and we are also not responsible for refunding any visa fees or other payments made in exchange for visa assistance or support with visa processing.

Changes to the agreed-upon travel itinerary might not be possible once the customer has completed and paid for their visa application. If the customer persists on canceling or making changes no refunds of the deposit shall be allowed at this stage and deposits paid will be forfeited except to the extent of any refund that the supplier may allow. Customers are therefore advised to make their changes before their visa is submitted on their behalf.

EMERGENCY MEDICAL TREATMENT

If a medical emergency occurs that prevents you from being able to authorize emergency treatment when it is needed, we or our agents will make an effort to contact your traveling companions or previously chosen emergency contact to ask permission for any necessary treatment. You give our representatives permission to give your consent to any medical treatment, including all types of medical examinations, diagnoses, medications, treatments, physician or hospital care, that is deemed necessary by, and is to be provided under, the supervision of any doctor or surgeon, if they decide in their sole discretion that the time or circumstances do not permit such communication. You consent not to hold us or our agents accountable for any activities involving such medical or emergency treatment.

LOCAL LAWS

You must always abide by the rules and ordinances of any location you visit while on vacation. If you engage in any unlawful activity, we have the right to terminate your trip and hold you legally accountable for any fines or penalties imposed by local authorities.

FORCE MAJEURE

There may be unforeseen events that are beyond anyone’s control, such as weather conditions, pandemics, quarantines, border closures, government or authority actions, wars, hostilities, political uprisings or civil disturbances, riots, strikes, terrorist activity or the threat of terrorist activity, criminal acts committed by third parties, defects in vehicles or equipment, or an Act of God, which necessitate a cancellation or modification. These events are regarded as a force majeure. We shall not be held accountable or liable in any way for such occurrences, including any resulting death, physical harm, disease, damage, delay, or other losses. While we will always make an effort to help our passengers in these situations, wherever they may be in the globe, the traveler will be liable for any losses or expenses incurred as a consequence of these occurrences.

SEVERABILITY

If any provision of these Terms is so broad as to be unlawful, unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in all respects in accordance with Nigerian law and shall be subject to the jurisdiction of Nigerian courts.

Any claim or dispute arising out of or relating to this agreement or the breach thereof shall in the first instance be attempted to be settled amicably by the Parties by way of direct negotiation.

If the dispute, difference or claim is not settled amicably within 30 (thirty) days, the dispute shall be referred to a single Arbitrator agreed to or appointed by the Parties.

In the event that Parties are unable to agree on a single Arbitrator within 30 days after which a Party has demanded that such dispute be referred to an Arbitrator, any of the Parties shall be entitled to require the appointment of an Arbitrator by the Chairperson of Chartered Institute of Arbitrators (UK), Nigerian Branch, who in making his appointment, shall have regard to the nature of the dispute in question and appoint an Arbitrator who is experienced and skilled in the area of dispute.

The arbitration shall be held in Lagos Nigeria, and conducted in the English Language.

The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act of Nigeria and the Rules made pursuant thereto.

The decision of the Arbitrator shall be final and binding on the Parties and Parties agree to be bound by it.

ACCEPTANCE

By paying the initial deposit for this package, you confirm that you have read, understood and agreed to these terms and conditions which will be binding on both parties. We reserve the right to update or alter these Terms at any time.
